Federal appeals courts are split over whether long-term residents can be held without an individualised bond hearing. On July 30, 2026 the Seventh and Ninth Circuits each ruled against the government two to one, following the Eleventh Circuit. The split now stands at six circuits to two, and the issue is widely expected to reach the Supreme Court.
