On August 13, 2026, the Board of Immigration Appeals overruled Matter of Arrabally and Yerrabelly. Under Matter of Delcarmen-Lara, leaving the United States under a grant of advance parole is now a “departure” that can make a person with a year or more of unlawful presence inadmissible for ten years. The Board applied the change prospectively: advance parole trips completed before this decision are still treated under the old rule.
