In this successful Ninth Circuit appeal, Shahid Haque argued that Yesenia Equihua-Equihua was entitled to attorney’s fees under the Equal Access to Justice Act. The court agreed, reversed the denial of fees, held that Equihua was a prevailing party and that the government’s position was not substantially justified, and referred the case for calculation of the award.
