ImmigrationProf Blog explains the Montana Supreme Court's unanimous decision striking down all of LR-121. The court held that although states may make some benefit decisions, Montana could not decide for itself who was lawfully present or use a definition that would deny services to people protected by federal immigration law.
The national immigration-law blog recognized Shahid Haque and Brian Miller's pro bono representation of MIJA. Its coverage placed the Montana victory within the larger constitutional rule that immigration classifications remain a federal responsibility.
