Montana to appeal judge's immigrant law ruling

The Associated Press reports that Attorney General Tim Fox would appeal the LR-121 ruling after the court resolved attorney-fee issues. The Board of Regents and commissioner of higher education declined to join the appeal. Shahid Haque said he expected the Montana Supreme Court to affirm and believed state agencies were relieved not to implement a law they understood was constitutionally flawed.

The announcement meant Shahid and MIJA's victory was not yet final and that the pro bono litigation would continue at the state's highest court.
